LEGAL AGREEMENT & SERVICE SCOPE

Welcome to MP Hardwood Flooring . By accessing our website, requesting an on-site estimate, or hiring us for flooring installation, hardwood floor repair, kitchen remodeling, bathroom remodeling, or general construction services, you agree to comply with and be bound by the following Terms and Conditions.1. Scope of Work & Project Estimates
  • All formal project proposals, subfloor evaluations, and cost estimates provided by MP Hardwood Flooring are valid for 30 calendar days from the date of issuance due to fluctuating raw material, timber, and shipping market costs.
  • A binding contract is established only when the client approves the written proposal and pays the required initial deposit.
  • Any modifications, additional material requests, or structural subfloor corrections requested after the commencement of work will be documented via a formal Change Order and billed separately.
2. Site Readiness, Acclimation & Subfloor Requirements
  • Timber Acclimation: For solid hardwood, custom timber inlays, and engineered wood installations, materials must acclimate inside the client’s climate-controlled property for a minimum of 48 to 72 hours prior to fitting. The client must maintain indoor relative humidity between 35% and 55% during this period.
  • Site Preparation: The job site must be clear of personal belongings, fragile items, and unapproved tradespeople prior to our installation team’s arrival. While our crews exercise extreme care, MP Hardwood Flooring is not liable for damage to unremoved personal items left within the active work zone.
  • Subfloor Integrity: Our estimates assume a structurally sound subfloor unless explicitly noted otherwise. If hidden dry rot, structural joist sagging, termite damage, or unmitigated slab moisture vapor is discovered upon removing old flooring, work will pause until a revised structural repair scope is agreed upon.
3. Payment Schedule & Late Fees
  • Deposit: A standard deposit (typically 30% to 50% depending on custom timber, cabinet, or tile material orders) is required to lock in installation dates and procure project materials.
  • Progress Payments: For large-scale kitchen remodeling, bathroom overhauls, and general construction projects, progress payments will be invoiced upon reaching defined structural milestones (e.g., framing completion, rough plumbing/electrical inspection, tile fitting).
  • Final Payment: The remaining balance is strictly due immediately upon final project walk-through and completion. Late payments exceeding 15 calendar days will accrue interest at a rate of 1.5% per month (or the maximum allowable by law) until paid in full.
4. Project Cancellations & Material Returns
  • Clients may cancel a scheduled service up to 7 business days prior to the start date without penalty, excluding non-refundable custom material purchases (such as laser-cut wood medallions, custom cabinets, or special-order tiles).
  • Restocking fees for standard returned materials (LVP, laminate, standard hardwood) will be charged to the client at the supplier’s going rate (typically 15% to 25%).

5. Workmanship Warranty & Limitations

  •  MP Hardwood Flooring provides a 1-Year Craftsmanship Warranty covering installation defects, loose planks, grout cracking due to installation error, and joint separation resulting from improper fitting.
  • This warranty does NOT cover:Damage caused by post-installation plumbing leaks, natural flooding, or structural house settling.Deep scratches, dents, or gouges caused by heavy furniture, sharp dog claws, or improper maintenance.Seasonal timber expansion or minor gaps resulting from severe humidity shifts outside recommended indoor levels (35%–55% RH).

6. Limitation of Liability & Dispute ResolutionTo the fullest extent permitted by law, MP Hardwood Flooring shall not be held liable for indirect, incidental, or consequential damages arising from site delays due to severe weather, supply chain disruptions, or third-party trade conflicts. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith mediation prior to formal legal action.
